Terms of Service

1. Agreement to Terms

By accessing or using Blitzergram (blitzergram.de), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.

Blitzergram is operated by Private Enterprise “ISMA-SERVICE” (ПП “ІСМА-СЕРВІС”), EDRPOU 33927324, registered in Ukraine.

2. Eligibility

You must be at least 16 years old to use Blitzergram. If you are under 18, you may use the service only with the involvement of a parent or legal guardian. By using Blitzergram, you represent that you meet these requirements.

3. The Service

Blitzergram is a privacy-first web application that allows German drivers to document, track, and optionally share their traffic fine history in an anonymized and gamified format.

We offer two tiers:

Free: Upload and track fines, optional blur zone for plates and faces, OCR-assisted data extraction, personal statistics, and public gallery viewing.

Pro: Everything in Free plus enhanced statistics, leaderboard access, priority processing, and additional features as announced.

We reserve the right to modify, suspend, or discontinue any part of the service at any time, with or without notice. We do not guarantee uninterrupted availability.

4. Important Disclaimers

4.1 No Legal Advice

Blitzergram is NOT a legal advisory service. The app does not provide legal advice and does not replace consultation with a licensed attorney. Information about fines, amounts, points, and deadlines displayed in the app is for personal documentation and entertainment purposes only. For legal questions regarding your fine notice (Bußgeldbescheid), please consult a licensed lawyer (Rechtsanwalt).

4.2 OCR Accuracy

Automatic text recognition (OCR) may contain errors. All displayed amounts, speeds, points, and dates are non-binding and may differ from actual values on your original notice. Always verify information against your original Bußgeldbescheid.

4.3 No Encouragement of Traffic Violations

Blitzergram does not encourage, glorify, or promote speeding or any traffic violations. The gamification features (leaderboards, scores) are designed as a lighthearted way to track an existing situation — not to incentivize dangerous driving. Drive responsibly and obey all traffic laws.

5. Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information and to notify us promptly if you suspect unauthorized access to your account. We may suspend or terminate accounts that violate these terms.

6. User Content & Document Uploads

6.1 Your Documents

You retain ownership of all documents and images you upload. By uploading content, you grant us a limited license to process, store, and display your uploaded content as part of the service functionality.

6.2 Your Warranties

By uploading content, you warrant that:

• You are uploading your own fine documents only
• The documents are authentic and unaltered
• You have the right to upload the content
• The content does not infringe third-party rights
• No identifiable third parties (passengers, bystanders) are clearly visible in your submitted photo without their consent

6.3 Public Sharing

If you choose to share a fine card to the public gallery, you explicitly consent to the card (with any user-applied blur) being visible to all visitors. You may unpublish a shared card at any time.

7. Acceptable Use

You agree not to:

• Use the service for any illegal purpose
• Upload documents belonging to other people without their consent
• Upload fabricated or falsified fine documents
• Attempt to circumvent payment, access controls, or rate limits
• Reverse engineer, decompile, or extract source code from the service
• Scrape, bot, or automate access to the service
• Interfere with the service or other users' experience
• Use the service to harass, stalk, or reveal another person's identity
• Impersonate any person or entity

8. Payments & Refunds

Pro features are available via one-time purchase or subscription, processed by Stripe. All prices include applicable VAT and are shown in EUR.

Right of Withdrawal (Widerrufsrecht): Because Blitzergram delivers digital content immediately upon purchase, you acknowledge and agree that you waive your right of withdrawal upon purchase confirmation, in accordance with § 356 Abs. 5 BGB and Article 16(m) of the EU Consumer Rights Directive. By completing your purchase, you consent to immediate delivery and confirm that you understand this waiver.

If you experience a technical issue that prevents you from accessing your purchase, contact us at support@blitzergram.de and we will work to resolve it.

9. Intellectual Property

Our content:The Blitzergram software, design, branding, and all associated materials are owned by Private Enterprise “ISMA-SERVICE” or its licensors. You may not copy, modify, distribute, reverse engineer, or create derivative works without our written permission.

Your content: Your uploaded fine documents and the data extracted from them remain yours. Anonymized statistical data derived from user uploads may be used in aggregate form.

10. Third-Party Services

Blitzergram integrates with third-party services including Stripe (payments), Supabase (authentication and data storage), and Vercel (hosting). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability or practices of third-party services.

11. Disclaimers

Blitzergram is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the service will be uninterrupted, error-free, or secure. OCR accuracy and image processing depend on document quality and your device capabilities, which we do not control.

12. Limitation of Liability

Unlimited liability: We are liable without limitation for damages caused by intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit), as well as for injury to life, body, or health.

Limited liability: In the event of slightly negligent breach of material contractual obligations (Kardinalpflichten), our liability is limited to the foreseeable, typically occurring damage.

Exclusion: Beyond the above, liability for slight negligence is excluded.

Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim, or EUR 10, whichever is greater.

These limitations also apply in favor of our vicarious agents (Erfüllungsgehilfen). Nothing in these terms excludes or limits liability that cannot be excluded under applicable law.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable attorney fees) arising from your violation of these terms, your uploaded content, or your misuse of the service — except to the extent caused by our own negligence.

14. Content Moderation & Reporting

We review shared content for policy compliance. If you believe content on Blitzergram violates your rights or applicable law, please report it to support@blitzergram.de. We will review and act on reports within a reasonable time.

15. Termination

You may delete your account at any time through your profile settings. We may suspend or terminate your access if you violate these terms. Upon termination, your right to use the service ceases immediately. Sections 4, 9, 11, 12, 13, and 17 survive termination.

16. Changes to These Terms

We may update these terms from time to time. If we make material changes, we will notify you by email or by posting a prominent notice on the site at least 14 days before the changes take effect. Your continued use of Blitzergram after the effective date constitutes acceptance of the updated terms.

17. Governing Law & Jurisdiction

These terms are governed by the laws of Ukraine. Any disputes shall be resolved in the courts of Ukraine. If you are an EU consumer, you retain any mandatory protections provided by the laws of your country of residence, and nothing in these terms restricts your right to bring proceedings in the courts of your domicile.

18. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions remain in full force and effect. The unenforceable provision shall be replaced by a valid provision that most closely reflects its economic intent.
