Terms of Service

1. Agreement to Terms

By accessing or using the Blitzergram iOS app or blitzergram.com, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.

Blitzergram is operated by Private Enterprise “ISMA-SERVICE” (ПП “ІСМА-СЕРВІС”), EDRPOU 33927324, registered in Ukraine.

2. Eligibility

You must be at least 16 years old to use Blitzergram. If you are under 18, you may use the service only with the involvement of a parent or legal guardian. By using Blitzergram, you represent that you meet these requirements.

3. The Service

Blitzergram combines an iOS app for creating and managing tickets with a website for viewing and sharing approved public previews, profiles, awards, and your own private collection.

iOS 1.2 is free: Record tickets, crop and hide private details, view personal yearly statistics, optionally share edited photos, react, comment and browse all-time awards. There are no purchases or paid features in iOS 1.2. The website is a viewing and sharing companion: it does not create, edit, publish, or react to tickets, create accounts, or start purchases.

We reserve the right to modify, suspend, or discontinue any part of the service at any time, with or without notice. We do not guarantee uninterrupted availability.

4. Important Disclaimers

4.1 No Legal Advice

Blitzergram is NOT a legal advisory service. The app does not provide legal advice and does not replace consultation with a licensed attorney. Information about fines, amounts, points, and deadlines displayed in the app is for personal documentation and entertainment purposes only. For legal questions regarding your fine notice (Bußgeldbescheid), please consult a licensed lawyer (Rechtsanwalt).

4.2 OCR Accuracy

Automatic text recognition (OCR) may contain errors. All displayed amounts, speeds, points, and dates are non-binding and may differ from actual values on your original notice. Always verify information against your original Bußgeldbescheid.

4.3 No Encouragement of Traffic Violations

Blitzergram does not encourage, glorify, or promote speeding or any traffic violations. The gamification features (leaderboards, scores) are designed as a lighthearted way to track an existing situation — not to incentivize dangerous driving. Drive responsibly and obey all traffic laws.

5. Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information and to notify us promptly if you suspect unauthorized access to your account. We may suspend or terminate accounts that violate these terms.

6. User Content & Document Uploads

6.1 Your Documents

You retain your rights in the content you submit. The iOS app reads the original ticket on your device and uploads only the edited photo you confirm and selected ticket fields, not the original letter or OCR transcript. You grant us the limited rights needed to store and display submitted photos, fields and comments according to your private/public choices and to moderate them.

6.2 Your Warranties

By uploading content, you warrant that:

• You submit your own tickets and photos, or have the necessary permission to do so
• You do not fabricate ticket values or misrepresent a photo; crop and redaction for privacy are expected
• You have the right to upload the content
• The content does not infringe third-party rights
• No identifiable third parties (passengers, bystanders) are clearly visible in your submitted photo without their consent

6.3 Public Sharing

If you choose to share a fine card to the public gallery, you explicitly consent to the card (with any user-applied blur) being visible to all visitors. You may unpublish a shared card in the iOS app at any time.

Comments on public tickets are visible to signed-in members with your alias and posting date. You can delete your own comments. Content must follow our Community Guidelines: no abusive, hateful, threatening, sexually explicit or unlawful material, private contact details or encouragement of dangerous driving. Report a comment or member through its menu or contact support. We may hide or remove content and restrict abusive accounts.

7. Pro and Previous Purchases

The website no longer offers checkout or new Pro purchases. Existing Pro access remains attached to the shared account. Earlier Stripe transactions may still be processed for completion, refunds or disputes. iOS 1.2 does not offer a Pro purchase or an external checkout link. Contact support about an earlier purchase.

8. Payments & Refunds

No new purchases are offered by the website or iOS 1.2. This section applies only to payments previously made through Stripe.

Statutory withdrawal, refund and consumer rights for earlier purchases remain available where applicable. These terms do not retrospectively obtain a waiver of those rights.

If you experience a technical issue that prevents you from accessing your purchase, contact us at support@blitzergram.com and we will work to resolve it.

9. Intellectual Property

Our content: The Blitzergram software, design, branding, and all associated materials are owned by Private Enterprise “ISMA-SERVICE” or its licensors. You may not copy, modify, distribute, reverse engineer, or create derivative works without our written permission.

Your content: Your uploaded fine documents and the data extracted from them remain yours. Anonymized statistical data derived from user uploads may be used in aggregate form.

10. Third-Party Services

Blitzergram integrates with third-party services including Stripe (legacy payments and refunds), Supabase (authentication and data storage), and Vercel (hosting). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability or practices of third-party services.

11. Disclaimers

Blitzergram is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the service will be uninterrupted, error-free, or secure. OCR accuracy and image processing depend on document quality and your device capabilities, which we do not control.

12. Limitation of Liability

Unlimited liability: We are liable without limitation for damages caused by intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit), as well as for injury to life, body, or health.

Limited liability: In the event of slightly negligent breach of material contractual obligations (Kardinalpflichten), our liability is limited to the foreseeable, typically occurring damage.

Exclusion: Beyond the above, liability for slight negligence is excluded.

These limitations also apply in favor of our vicarious agents (Erfüllungsgehilfen). Nothing in these terms excludes or limits liability that cannot be excluded under applicable law.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable attorney fees) arising from your violation of these terms, your uploaded content, or your misuse of the service — except to the extent caused by our own negligence.

14. Content Moderation & Reporting

We automatically check edited photos selected for publication. Photos that pass can appear immediately. Flagged photos and failed checks wait for human review. We may also review or remove shared content after publication. If you believe content on Blitzergram violates your rights or applicable law, please report it to support@blitzergram.com. We review and act on reports within 48 hours. You can also report content and block members from their card, comment or profile menu in iOS. An amount or speed not counting for awards is separate from content removal: recorded values remain in your personal statistics. We explain the affected value and its eligibility status in the app. If you disagree, email support with the ticket reference to request human reconsideration. A moderator rejection may be kept with the account after a ticket is deleted to prevent bypass by re-upload.

15. Termination

You may delete your account at any time through your profile settings. We may suspend or terminate your access if you violate these terms. Upon termination, your right to use the service ceases immediately. Sections 4, 9, 11, 12, 13, and 17 survive termination.

16. Changes to These Terms

We may update these terms from time to time. If we make material changes, we will notify you by email or by posting a prominent notice on the site at least 14 days before the changes take effect. Your continued use of Blitzergram after the effective date constitutes acceptance of the updated terms.

17. Governing Law & Jurisdiction

These terms are governed by the laws of Ukraine. Any disputes shall be resolved in the courts of Ukraine. If you are an EU consumer, you retain any mandatory protections provided by the laws of your country of residence, and nothing in these terms restricts your right to bring proceedings in the courts of your domicile.

18. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions remain in full force and effect. The unenforceable provision shall be replaced by a valid provision that most closely reflects its economic intent.
